Website www.ancapoterasu.com is owned by GALERIA ANCA POTERASU SRL, located in Romania, Strada ION BREZOIANU, Nr. 23-25, CORP A, CAM. AE1.1, Floor 1, Bucharest, registered at the Trade Register under no. J40/20226/2007 and CUI 22649476 (hereinafter referred to as “we” or “Anca Poterasu Gallery”).

We reserve the right at any time, without prior notice, to discontinue the operation of this Site or to make any changes we deem necessary, or to modify or supplement, in whole or in part, these Terms and Conditions.

Please review these Terms and Conditions whenever you visit this Site and note any changes or additions that may have been made since your last visit.

This Site presents information on the services provided by Anca Poterasu Gallery in connection with the sale of artworks exhibited on the site.

If you do not comply with these Terms and Conditions and we do not take immediate action, this does not indicate that we waive any rights we have (for example, the right to take action in the future).

If certain terms and conditions are found to be unenforceable or invalid, this shall not affect the rest of the Terms and Conditions.

Principles of use of this Site

To order a work exhibited on the ancapoterasu.com , you must enter the data you are asked to enter in order to place the order.

While using this Site you are required to NOT:

Sales Policy

Access to place an order is open to any person of any nationality who is at least 18 years of age at the time of placing the order. Minors may place orders for works displayed on the site only through their guardian or legal representative.

Orders can be placed online via the website or by email at contact@ancapoterasu.com.

All rates for items presented on the Site are expressed in lei ( RON ).

For justified reasons, Anca Poterasu Gallery reserves the right to restrict any person from placing an order and/or using any of the accepted payment methods.

Cancellation of an order can be made by email within 24 hours of placing the order.

Payment methods

The methods of payment for services on the website are: online payment.

In the case of online payments, Anca Poterasu Gallery is/cannot be held responsible for any other additional costs incurred by you, including but not limited to currency conversion fees applied by your card issuing bank, if the currency of issue differs from RON. You are solely responsible for these payments and fees.

Anca Poterasu Gallery reserves the right to cancel any order placed, following prior notice to you, without any additional obligation and without either party being able to claim damages or delivery of the product from the other, if:

• Online payment of the transaction is declined by your card issuer;
• The online payment is invalidated by the payment processor approved by Anca Poterasu Gallery;
• The data provided by you are incomplete and/or incorrect;
• In any other duly justified cases, e.g. when a derisory price is displayed in error.

If, for reasons beyond the Buyer’s control, the work ordered and paid for cannot be delivered, Anca Poterasu Gallery undertakes to refund the Buyer, within a maximum of 10 days, the amounts paid by the Buyer. We assure you that we make every effort to ensure that such situations do not occur or occur with extremely low frequency.

Delivery

Courier delivery is available throughout Romania and internationally. Anca Poterasu Gallery will ensure the proper packaging of the order and the transmission of the accompanying documents to you. 

Delivery of the order will be ensured by a courier company providing specialised services, adapted to the transport of sensitive and valuable objects. Anca Poterasu Gallery reserves the right to collaborate with any company providing such courier services. 

Delivery costs  are borne by you, they differ according to the delivery address and are displayed at the time of placing the order.

In Romania, the order will be delivered within 3-5 working days from the moment of order confirmation, except for public holidays. Delivery terms for international addresses may vary and will be communicated after placing the order.

In the event of exceptional circumstances, such as but not limited to extreme weather conditions or busy periods of the delivery agent or any other special circumstances or force majeure, delivery of the order may be delayed without fault of Anca Poterasu Gallery and without Anca Poterasu Gallery owing any damages in this regard.

Return Policy

According to the legal provisions, you have the right to return the purchased artwork (“product(s)”) within a maximum of 14 days from the moment you take possession of it. 

To exercise this right, you must notify us in writing within 14 days of your intention to return the product. The notification will be made by email to the following address: contact@ancapoterasu.com

Upon receipt of the Notification, Anca Poterasu Gallery will contact you to establish the details of the return – by e-mail.

The costs of return will be borne entirely by you as the Buyer.

The returned product must be in the same condition in which it was delivered (in the original packaging with all accessories, with intact labels and accompanying documents). Products with physical alterations, dents, nicks, scratches, dents, dents, signs of unauthorized use and/or tampering, etc. will not be accepted for return. You are responsible for any diminished value of the products resulting from handling, other than that necessary to determine the nature, quality and function of the products.

Excepted from the right of withdrawal are sealed audio or video recordings which have been unsealed after delivery, newspapers, periodicals and magazines except for subscription contracts for the supply of such publications, digital content which is not delivered on a tangible medium, if the performance has begun with the express prior consent of the purchaser and after the purchaser has confirmed that he is aware that he will lose his right of withdrawal (e.g. ebook).

From the moment of receipt of the return, Anca Potersu Gallery has a period of 30 days l to refund the value of the returned product.

Anca Poterasu Gallery reserves the right to refuse receipt of the products and to return the countervalue to the buyer in the following situations:

1. The Buyer has failed to give notice in accordance with these terms and conditions;
2. The buyer has not returned the product as stated in these terms and conditions;
3. The returned product has suffered damage or any alterations that diminish its value other than those necessary to determine the nature, qualities and functioning of the products.
4. The returned product is exempted from the right of withdrawal under Emergency Ordinance No 34/2014 on consumer rights in contracts with professionals, as well as amending and supplementing certain legislative acts.

Intellectual property 

The content of this site is the property of Anca Poterasu Gallery, unless otherwise noted or third party rights may otherwise be asserted.

Any unauthorized use, including, but not limited to, copying, reproduction, use, transmission, sale, licensing or distribution, without the prior written consent of Anca Poterasu Gallery, of the contents of this Site, the marks on this Site or the programming code of the elements of this Site, for any purpose other than for personal use, is expressly prohibited and may constitute an infringement of copyright, trademark law or other industrial property rights.

These Terms and Conditions are governed by the laws of Romania.
